Public consultation regarding the implementation of the new NOC 2021 started by ONIP, along with developments in the language and education requirements for certain Employer Job Offer streams

In accordance with a 6 September media release, Ontario is planning to align the (ONIP)  Ontario Immigrant Nominee Program with the new (NOC) National Occupation Classification 2021.

The NOC 2021 system is already implemented by (EDSC) Employment Development Canada and (StatsCan) Statistics Canada and starting this  November (IRCC)  Immigration, Refugees and Citizenship Canada will also be implementing it.

This implementation of the NOC 2021 system will have a great effect on the ONIP Original system since the occupations eligible for each stream will be changed such as Ontario’s (PNPs)  Provincial Nominee Programs will fall under  TEER 0, 1, 2, or 3 instead of the original requirement of a  job offer or work experience in NOC skill types 0, A, or B and according to the amendments, in regards to the  Employer Job Offer In-Demand Skills stream of the ONIP instead of the job offer in select NOC Skill Level C or D occupations it now requires job offers in select TEER 4 or 5 occupations under NOC 2021. There are also certain occupations that will be changing their NOC labels under the new NOC 2021 which will have an impact on which streams they are eligible for.

Details regarding the NOC 2021 system are displayed on the  Statistics Canada website and on IRCC’s website. More updates will be posted on the OINP website.

Ontario is also suggesting that having a (CLB) Canadian Language Benchmark of Level 5 or above should be made a requirement for applicants of the Employer Job Offer Foreign Worker stream.

It is also stated by the province that adding the new language requirements would align the program’s goal of increasing the successful integration of employees along with protecting both the applicants and the ONIP from integrity problems.

There are also discussions on the Education criteria for the Employer Job Offer International Student stream. People who are applying with a certificate of at least one year are required by Ontario to meet the criteria of Graduate Certificate from the Ontario college which is explained in the Ontario Qualifications Framework.

The OINP says, “For International Student stream applicants are applying with one-year certificates this amendment is expected to offer clarity and reduce burdens for them and lastly Ontario is looking to change the minimum amount required for the OINP’s administrative monetary penalties.

The amendments are displayed on Ontario’s Regulatory Registry for public view and the public can also offer feedback to Ontario regarding the proposed changes until 21st October 2022.

Affects on Express Entry eligibility caused by NOC 2021

It is expected that the IRCC will implement NOC 2021 on 16th November. Once this happens the alterations made to the Express Entry occupations will ultimately affect the eligibility for Ontario’s Express Entry-aligned PNPs.

The  proposed regulatory alterations will make the following eligible for Express Entry through them:

  • Payroll administrators

  • Pharmacy technical assistants and pharmacy assistants

  • Elementary and secondary school teacher assistants

  • Estheticians, electrologists, and related occupations

  • Correctional service officers

  • Other repairers and servicers

  • Dental assistants and dental laboratory assistants

  • Sheriffs and bailiffs

  • Nurse aides, orderlies, and patient service associates

  • Heavy equipment operators

  • Other repairers and servicers

  • Transport truck drivers

  • Residential and commercial installers and servicers

  • Aircraft assemblers and aircraft assembly inspectors

  • Bus drivers, subway operators, and other transit operators

  • Pest controllers and fumigators

On the other hand, the following occupations will become ineligible specifically through Ontario’s Immigrant Nominee Program:

  • Other performers

  • Program leaders and instructors in recreation, sport, and fitness

  • Tailors, dressmakers, furriers, and milliners

However, these occupations will still be eligible for other programs with broader job eligibility requirements, such as certain PNP streams.
